Dealing with Age Discrimination on the Job: How an Employment Lawyer Can Help

Age discrimination is a reality in many workplaces. Some employers treat their employers differently based on their age. However, age discrimination on the job is illegal. It can happen in job ads, during job interviews, and on the job. Victims of age discrimination in the workplace can be compensated differently, denied promotions, or even terminated. Thankfully, laws are imposed to protect workers against this form of discrimination. Age Discrimination in Different Forms

Age discrimination at work can happen in the form of the following:

  • Harassment. If you have been consistently harassed by anyone in your workplace because of your age, you can be a victim of age discrimination. While this kind of harassment does not have a direct impact on your income, it can make your life at work hard that you may even want to quit. If you constantly experience harassment in your workplace, document what your harasser said, when they said it, and where. Also, write down any witnesses. 
  • Promotion denial. When you are no longer getting promotions due to your age or are being passed over by younger counterparts despite your qualification, you can be dealing with age discrimination. 
  • Unjust disciplinary measures. If you have been disciplined because of your age and your supervisor let younger workers off the hook, age discrimination is a reality in your workplace. 
  • Favoritism. Age discrimination also occurs when older workers are terminated without a reasonable cause, not included in meetings or gatherings, or provided with the worst assignments. 

Proving Age Discrimination

Because the majority of employers will not be clear about their reason for firing an employee or hiring an applicant, age discrimination can be hard to prove and requires a lawyer’s assistance. If you notice this practice in your workplace, document it in detail. Gather evidence and get the details in writing. Your attorney can use these notes if you become one of the victims and decide to file a claim. 

When you decide to speak up, you need a qualified lawyer to guide you through the process. Your attorney will ensure you meet deadlines and file accurate paperwork on time. Also, they can help prove your employer was motivated to act due to age despite their denial. They can dispute the claim of your employer by presenting concrete evidence that shows how they have made you a victim of age discrimination.
